Epic Law Firm terms & conditions
01. Scope
These Terms of Business shall apply to services provided by Epic Advokater, unless we have agreed in writing that other terms are to apply.
02. Our fee
Unless we have agreed in writing that other terms are to apply, our fee will be based on parameters like: 1) the amount of time spent on the assignment, 2) the employees involved in the handling of the assignment, 3) the complexity of the assignment, 4) whether the assignment has resulted in significant time pressure or work outside of normal working hours, 5) the importance of the assignment for your business, 6) the responsibility involved in undertaking the assignment, and 7) the results achieved.
03. Fixed or estimated price
If a fixed price or an estimated price has been agreed upon, this price is conditional on the task being solved within the estimated time and that no circumstances appear which will complicate the handling of the assignment and which we could not reasonably have been foreseen. However, we are obliged to inform you immediately if we discover that a fixed price cannot be met, or if an estimated price is exceeded by more than 20%.
04, Invoicing
We usually issue an invoice when the assignment has been completed. If an assignment is carried over into the next month, an invoice will be issued by the end of each month. Furthermore, an invoice will be issued on certain occasions, e.g. after the filing of a pleading. Some services are invoiced in advance, and we are always entitled to ask for advance payment and effect a set-off against any amount deposited with us. We are entitled to send invoices by email only. Any special requests concerning invoicing from you, including a request for electronic invoicing or a certain amount of credit days, will only apply if this has been accepted in writing by Epic Advokater.
05. Disbursements
Generally, Epic Advokater does not incur disbursements on behalf of you as a client. If we incur disbursements on behalf of you or your business, we are entitled to refund on demand or to effect a set-off against any amount deposited with us.
06. Transport
Time spent on transportation is invoiced at the standard hourly rates, unless otherwise agreed. Transport costs are charged on the basis of the rates fixed by the Danish State or the actual expenses paid, including for accommodation and meals and refreshments.
07. Urgent assignments
In case of urgent assignments which have to be solved “here and now”, and this involves compulsory work outside of normal working hours (8 a.m. to 6 p.m.) or during weekends or bank holidays, we are entitled to increase our regular hourly rate by 50% for work between 6 p.m. and 10 p.m. and between 6 a.m. and 8 a.m. during weekdays. For work between 10 p.m. and 6 a.m. on weekdays as well as during weekends and bank holidays, we are entitled to increase the rate by 100%. This does not apply if a fixed price has already been agreed upon.
08. Terms of payment
Payment of invoices is due within 8 days following the date of invoice. However, invoices concerning disbursements fall due for payment on receipt of the invoice. In case of delayed payment, we are entitled to stop all work for you without further notice and to charge interest from the due date. We are entitled to charge a fee for sending reminder letters based on the rates fixed pursuant to legislation.
09. Liability
We have taken out insurance with HDI, Policy No. 56-08416540-30019, and we are liable for damages pursuant to the general rules of Danish law, however any liability for damages is limited to the maximum of the sum covered by the insurance. In the case of Epic Advokater, the liability for damages is limited to maximum DKK 5 million per damage per year and DKK 2.5 million per attorney per year, and you as a client cannot claim any higher amount for a damage. Other simultaneous claims against Epic Advokater may reduce this maximum amount. Epic Advokater’s liability does not include consequential financial loss, operational loss, loss of profits, loss of goodwill, expenses to restore data, image or any other indirect loss. Only the person to whom or business to which we have provided services may claim damages.
10. Confidentiality
We will keep confidential all information we receive unless such information is not confidential under the circumstances, or if we are required by law to disclose such information. If possible, we will inform you at the latest when we disclose such information to a third party.
11. Personal data
We comply with the rules of the Danish Data Protection Act. You are always welcome to contact us regarding the information we have stored about your business. The information will be deleted when no longer required or if we are no longer obliged to store it. We use Ivision ApS and Microsoft as our data processor.
12. Your money/client funds
Epic Advokater does not manage funds on behalf of our clients. We will refer you to good colleagues.
13. Advance deposit
We are entitled to request an advance deposit before we commence an assignment. Advance deposits will be treated as client funds until the assignment is invoiced.
14. Money laundering
In order to avoid financing of terrorism, all Danish law firms are subject to a strict set of rules, which require us to obtain information of your identity. For companies, this includes information about the persons who are the ultimate owners of more than 25% of a company. On our request, you as a client is obliged to procure a copy of your passport and residential documentation for identification purposes. Any reasonable expenses related to such identity check shall be paid by you.
15. Governing law and venue
Any legal action against Epic Advokater shall be submitted to the Copenhagen City Court and be settled pursuant to Danish law. This also applies if you are a foreign national and/or the legal services are to be used abroad or cause damage abroad.
16. Communication
We communicate by email, unless otherwise agreed. Our emails are not encrypted unless you ask for it. Our systems are checked for viruses, malware etc. according to recognised standards, but we do not in any way assume liability, if the emails or attached files should contain any harmful viruses etc. We therefore recommend that you check all emails and attached files for harmful viruses etc. before opening them.
17. Withdrawal
We are entitled to withdraw from any assignment in case of any due unpaid amount, or if a requested advance deposit has not been paid. We furthermore reserve the right to withdraw from an assignment, if the assignment in our opinion does not benefit you or in case you do not provide the requested assistance for the assignment.
18. Attorney letter
Attorney letters will be prepared when we receive a request from you or your accountant. Attorney letters is invoiced according to the time spent, however, at least DKK 1,500 ex. VAT.
19. Complaints
Epic Advokater is subject to the general rules of the Danish Bar and Law Society in respect to complaints.
If our assistance or fees do not meet your expectations, please contact us. If we cannot solve a disagreement, you may refer the matter to the Disciplinary Board by sending a letter or an email to:
